How Van de Venter Mojapelo (Pty) Ltd collects, uses, protects and shares personal information, in line with the Protection of Personal Information Act, 4 of 2013 (POPIA).

Van de Venter Mojapelo (Pty) Ltd (“VVM”, “we”, “us”), registration number 1993/005612/07, is a debt recovery agency registered with the Council for Debt Collectors (registration 0013148/05). For the purposes of POPIA, VVM is a responsible party and, where we collect on behalf of credit providers, an operator processing information on their instructions.

2. Information We Collect
Depending on your relationship with us, we may process the following personal information:
- Identity details — name, surname, identity number, date of birth;
- Contact details — telephone numbers, email and physical addresses;
- Financial details — account balances, payment history, employment and income information relevant to an account or arrangement;
- Records of our interactions with you, including call recordings, correspondence and payment arrangements;
- Website usage information collected through cookies and similar technologies.
3. How We Obtain Information
We collect personal information:
- from the credit providers who appoint us to recover accounts;
- directly from you, when you contact or transact with us;
- from lawful third-party sources such as credit bureaus, tracing databases and publicly available records, where permitted by law.
4. Why We Process Information
- to recover outstanding debt on behalf of our clients;
- to verify your identity and maintain accurate account records;
- to negotiate, conclude and administer payment arrangements;
- to comply with legal and regulatory obligations, including the Debt Collectors Act and POPIA;
- to respond to enquiries, disputes and complaints;
- to protect our legal rights and prevent fraud.
5. Lawful Basis
We process personal information where it is necessary to pursue the legitimate interests of VVM and the credit providers we represent (the collection of lawfully owed debt), to comply with legal obligations, to perform in terms of a contract, or with your consent where required.
6. Who We Share Information With
- the credit provider on whose behalf we are collecting, and their authorised agents;
- service providers who support our operations (for example IT, payment processing and tracing services), under written obligations of confidentiality and security;
- attorneys, courts, regulators and other parties where required for legal proceedings or by law;
- credit bureaus, where reporting is required or permitted.
We do not sell personal information. Where information is transferred outside South Africa, we ensure the recipient is subject to laws or agreements providing an adequate level of protection as required by POPIA.
7. Security
We apply appropriate, reasonable technical and organisational measures to protect personal information against loss, unauthorised access or unlawful processing — including access controls, encryption in transit and staff confidentiality undertakings. Should a data breach occur that is likely to cause harm, we will notify the Information Regulator and affected data subjects as required by POPIA.
8. Retention
We retain personal information only for as long as necessary for the purposes described above, or as required by law (for example record-keeping requirements under the Debt Collectors Act and tax legislation). Thereafter records are securely destroyed or de-identified.
9. Your Rights
Subject to POPIA, you have the right to:
- be informed that we hold personal information about you;
- request access to the information we hold (see our PAIA Manual for the procedure);
- request correction or deletion of inaccurate information;
- object to processing, on reasonable grounds, or withdraw consent where processing is based on consent;
- lodge a complaint with the Information Regulator of South Africa (inforegulator.org.za).
